Welcome to this interactive video dedicated to the 1954 Hague Convention
for the Protection of Cultural Property in the Event of Armed Conflict
and its two (1954 and 1999) Protocols
It aims to provide information on the ratification and implementation of these instruments.
The International Register of Cultural Property under Special Protection is an international list of cultural property established by the 1954 Hague Convention. Cultural properties inscribed on the register are placed under the special protection, which represents a higher level of protection in comparison with the general protection concerning all cultural property.
Parties to the 1954 Hague Convention have the possibility to submit their cultural properties for their inscription on the International Register of Cultural property under Special Protection.
Granting of special protection is subject to two conditions:
1 The cultural property in question must be situated at an adequate distance from any large industrial center or from any important military objective constituting a vulnerable point.
2 Such property may never be used for military purposes.
All States Parties to the 1954 Hague Convention may submit to the Director-General of UNESCO an application for the entry in the Register.
Le Registre international des biens culturels sous protection spéciale est une liste internationale de biens culturels établie par la Convention de La Haye de 1954. Les biens culturels inscrits au Registre sont placés sous la protection spéciale, qui représente un niveau de protection plus élevé par rapport à la protection générale concernant tous les biens culturels.
Les parties à la Convention de La Haye de 1954 ont la possibilité de soumettre leurs biens culturels pour leur inscription au Registre international des biens culturels sous protection spéciale.
L'octroi de la protection spéciale est soumis à deux conditions :
1 Le bien culturel en question doit être situé à une distance suffisante de tout grand centre industriel ou de tout objectif militaire important constituant un point vulnérable.
2 Ces biens ne doivent jamais être utilisés à des fins militaires.
Tous les États parties à la Convention de La Haye de 1954 peuvent présenter au Directeur général de l'UNESCO une demande d'inscription au Registre.
The First Protocol is specific to the protection of movable cultural property in the event of occupation that was also adopted in 1954 along with the 1954 Hague Convention.
The First Protocol regulates the protection of cultural property in situations of occupation through the following:
• It prohibits all exportations from the occupied territory and requires the return of cultural property to the territory of the State from which the property was exported.
• It prohibits the retention of cultural property. When the occupation ends, the State must return the cultural object to the formerly occupied authorities.
• It prohibits the sale of the cultural property. If the cultural property is sold, the purchaser is entitled to fair compensation to be paid by the occupying power.
Le Premier Protocole est spécifique à la protection des biens culturels meubles en cas d'occupation. Il a également été adopté en 1954 en même temps que la Convention de La Haye de 1954.
Le Premier Protocole réglemente la protection des biens culturels dans les situations d'occupation de la manière suivante :
• Il interdit toute exportation du territoire occupé et l'exigence du retour des biens culturels sur le territoire de l'État d'où ils ont été exportés.
• Il interdit la rétention des biens culturels. Lorsque l'occupation prend fin, l'État doit retourner le bien culturel aux autorités anciennement occupées.
• Elle interdit la vente du bien culturel. Si le bien culturel est vendu, l'acquéreur a droit à une juste compensation qui sera versée par la puissance occupante.
The Second Protocol aims to complement, clarify and expand the provisions of the 1954 Hague Convention:
• It creates a new category of “enhanced protection”, for cultural property of the greatest importance for humanity.
• It increases the reactiveness of the Convention, by defining sanctions to be imposed for serious violations with respect to cultural property and defines the conditions in which individual criminal responsibility shall apply.
• It establishes a twelve-member Intergovernmental Committee to oversee the implementation of the Second Protocol and de facto the Convention.
Le Deuxième Protocole vise à compléter, clarifier et élargir les dispositions de la Convention de La Haye de 1954 :
• Il crée une nouvelle catégorie de "protection renforcée", pour les biens culturels de la plus haute importance pour l'humanité.
• Il accroît la réactivité de la Convention, en définissant les sanctions à imposer en cas d'atteintes graves aux biens culturels et définit les conditions dans lesquelles la responsabilité pénale individuelle s'applique.
• Il établit un Comité intergouvernemental de douze membres pour superviser la mise en œuvre du Deuxième Protocole et de facto de la Convention.
Following national authorities may be involved in the process of nomination of sites for their inscription, by the Committee of the 1999 Second Protocol, on the International List of Cultural Property under enhanced protection:
• Permanent Delegation to UNESCO.
• National Commission for UNESCO.
• The Minister of State responsible for the protection of cultural property (i.e. the Minister of Culture) and the Ministry which supervises all relevant process, including identification and nomination of sites, adoption of relevant preparatory safeguarding measures.
• National Advisory Committee, established in line with Resolution II of the 1954 Hague Conference, if any, and under the authority of the Minister of State or senior official responsible for protection of cultural property.
• The site manager of the cultural property proposed for nomination, who is responsible for the implementation of relevant preparatory safeguarding measures. The site manager could be in charge of preparing the nomination dossier.
Les autorités nationales suivantes peuvent être impliquées dans le processus de proposition de sites pour leur inscription, par le Comité du Deuxième Protocole de 1999, sur la Liste internationale des biens culturels sous protection renforcée :
• Délégation permanente auprès de l'UNESCO.
• Commission nationale pour l'UNESCO.
• Le ministre d'État responsable de la protection des biens culturels (c'est-à-dire le ministre de la Culture) et le ministère qui supervise tous les processus pertinents, y compris l'identification et la proposition d'inscription des sites, l'adoption de mesures préparatoires de sauvegarde pertinentes.
• Le comité consultatif national, établi conformément à la Résolution II de la Conférence de La Haye de 1954, s'il existe, et sous l'autorité du ministre d'État ou du haut fonctionnaire chargé de la protection des biens culturels.
• Le gestionnaire du site du bien culturel proposé pour inscription, qui est responsable de la mise en œuvre des mesures préparatoires de sauvegarde pertinentes. Le gestionnaire du site peut être chargé de préparer le dossier de proposition d'inscription.
The declaration of “non-military use” is a unilateral document signed by the representative authorized by the Party which has control over the cultural property as competent for this matter (i.e. Head of the Government, the Minister of Defense etc.).
It aims to ensure that the site will not be deliberately used for military purpose or to shield military sites.
La déclaration de « non-utilisation à des fins militaires" est un document unilatéral signé par le représentant autorisé par la Partie qui a le contrôle du bien culturel comme étant compétente en la matière (c'est-à-dire le chef du gouvernement, le ministre de la défense, etc.).
Elle vise à garantir que le site ne sera pas délibérément utilisé à des fins militaires ou pour protéger des sites militaires.
